These Terms of Service govern your access to and use of www.svarnadeep.com and your purchase of products or services offered through the Website. By accessing the Website, creating an account, placing an order, or otherwise using our services, you agree to these Terms together with our Privacy Policy, Shipping Policy, and Return & Refund Policy.

1. Eligibility and Account Information

You must be legally capable of entering into a binding contract to place an order. If you are under 18 years of age, purchases should be made by or with the involvement of a parent or lawful guardian. You agree to provide accurate, current, and complete information, including contact, billing, payment, and delivery details.

2. Product Information, Images and Availability

We aim to display accurate product names, descriptions, sizes, quantities, materials, specifications, prices, images, stock status, country-of-origin or importer information where required, and other material information. Screen settings, photography, packaging updates, manufacturing batches, or natural materials may cause reasonable visual differences.

3. Prices, Taxes, Promotions and Errors

Prices are shown in the currency displayed on the Website. Applicable taxes, shipping charges, COD charges, duties, or other charges, if any, will be disclosed at or before checkout to the extent required and reasonably determinable. Promotions, coupons, bundles, and special prices may have additional stated conditions and may not be combinable unless expressly allowed.

If an obvious pricing, description, stock, tax, or technical error affects an order, we may contact you to confirm the corrected terms or cancel the affected item. If we cancel after receiving payment, we will issue a full refund for the cancelled amount.

4. Orders and Acceptance

Submitting an order is an offer to purchase. An automated order acknowledgement confirms that we have received the order; it does not prevent us from conducting payment, fraud, stock, address, serviceability, or pricing checks. We may refuse or cancel an order for legitimate reasons such as stock unavailability, payment failure, suspected fraud, pricing/listing error, legal restriction, courier non-serviceability, or inability to fulfil the order.

If we cancel an order after payment, the cancelled amount, including any shipping charge attributable solely to the cancelled item/order, will be refunded to the original payment method or another lawful refund method where necessary.

5. Recommended Cancellation Rules

  • A customer may request cancellation without a cancellation fee before the order has been dispatched or irrevocably committed to a specifically agreed custom/bulk/special-procurement process.
  • Once an order has been dispatched, ordinary cancellation is not available. Please contact customer support immediately if there is a delivery problem; refusal of delivery may result in the parcel being treated as Return-to-Origin (RTO).
  • If we cancel an order for our own reasons, a full refund of the cancelled amount will be issued and no cancellation charge will be deducted.
  • We do not impose an arbitrary cancellation penalty. Any treatment of genuine, non-recoverable shipping costs in an RTO situation will be subject to applicable law and the disclosures made for that order.
  • Repeated fraudulent orders, repeated unjustified COD refusals, or abuse of the ordering process may result in COD or account restrictions for future orders, without affecting statutory consumer rights.

Bulk, temple, institutional, wholesale, private-label, or specially packed orders may have separate commercial terms. Once special procurement, production, packing, or customization has started, cancellation may not be possible except where required by law or where we agree otherwise in writing.

6. Payments

Payment methods available for a particular order will be displayed at checkout. Payments may be processed by third-party payment gateways and banks. We generally do not store complete card credentials on our own servers. You authorize the selected payment provider to process the transaction according to its terms and applicable law. Where Cash on Delivery is enabled, availability may depend on pin code, order value, product category, fraud controls, or courier capability. Any COD charge will be displayed before order confirmation.

7. Shipping, Delivery and Risk

Our normal order-processing/dispatch target is 1-2 business days after order/payment confirmation, excluding Sundays, public holidays, unusually high-volume periods, stock verification, bulk/custom work, or circumstances outside reasonable control. Actual delivery time after dispatch depends on destination, serviceability, courier performance, weather, public events, and other logistics factors. Delivery dates shown on the Website or by a courier are estimates unless expressly stated to be guaranteed.

Risk of accidental loss or damage remains with us until the order is delivered to you or your authorized recipient, subject to applicable law. Please refer to the Shipping Policy for detailed rules concerning tracking, failed delivery, delays, lost shipments, and international orders.

International shipping may be offered only for destinations enabled at checkout or confirmed by us in writing. The customer is responsible for providing accurate import information and for customs duties, import taxes, destination charges, or regulatory requirements unless the order confirmation expressly states otherwise.

8. Returns, Replacements and Refunds

We do not offer general change-of-mind or satisfaction-based returns. Return, replacement, or refund requests are accepted only for eligible damaged, defective, missing, or incorrect products, or where another remedy is required by applicable law. 9. Bulk, B2B, Wholesale and Special Orders

Bulk, temple, institutional, wholesale, private-label, or specially packed orders may have separate commercial terms. Once special procurement, production, packing, or customization has started, cancellation may not be possible except where required by law or where we agree otherwise in writing.

Where a written quotation, purchase order, proforma invoice, marketplace/business agreement, or separate commercial contract applies, that document will govern the specific commercial terms to the extent it does not unlawfully reduce mandatory consumer rights.

10. Customer Responsibilities and Prohibited Use

You agree to use the Website and products lawfully and responsibly. You must not misuse the Website, interfere with security, upload malicious code, scrape or extract data in a manner that disrupts the service or violates law, impersonate another person, place fraudulent orders, misuse promotions, infringe intellectual property, or use the Website to facilitate unlawful activity.

You are responsible for checking product suitability, compatibility, instructions, warnings, measurements, and intended use before purchase and use. This does not make you responsible for defects, misleading information, or other matters for which the law places responsibility on us, a manufacturer, or another party.

11. Reviews, Feedback and User Content

If you submit a review, photograph, question, feedback, or other content, you confirm that you have the right to submit it and that it is truthful and lawful. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, and use that content for operating, improving, and promoting the Website and our products, subject to applicable privacy and advertising laws. We may remove unlawful, abusive, fraudulent, misleading, or irrelevant content, but we do not undertake to monitor every submission.

12. Intellectual Property

The Website design, brand names, logos, original text, graphics, photographs, videos, product content, and other materials owned by or licensed to Svarnadeep are protected by applicable Indian intellectual property laws and international treaties. You may use the Website for personal and lawful commercial purchasing purposes, but you may not reproduce, republish, distribute, modify, exploit, or falsely claim ownership of protected material without authorization.

The Website may use or link to third-party services such as Shopify, payment gateways, logistics providers, analytics tools, social-media platforms, customer-support tools, review platforms, or manufacturer websites. Those third parties may have their own terms and privacy policies. We remain responsible for our own legal obligations and do not exclude liability merely because a service provider is involved.

Our handling of personal data is governed by our Privacy Policy. The Website may use essential, functional, analytics, and advertising cookies or similar technologies. Where consent is required, we will seek it in accordance with applicable law. Transactional communications required to complete an order may still be sent even if you opt out of promotional marketing.

15. Warranties and Statutory Rights

Products may carry manufacturer warranties where expressly stated. Any manufacturer warranty is additional to, and does not replace, rights that cannot be excluded under applicable consumer law. Except for warranties expressly stated by us or required by law, we do not make additional guarantees about uninterrupted Website availability or outcomes that depend on factors outside our control.

16. Limitation of Liability

To the maximum extent permitted by law, neither party will be liable to the other for remote or indirect losses that were not reasonably foreseeable from the transaction. Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury where liability cannot lawfully be excluded, product liability or consumer remedies that cannot be waived, or any other liability that applicable law does not permit us to exclude.

17. Indemnity for Unlawful Misuse

If your unlawful or fraudulent misuse of the Website, infringement of third-party rights, or material breach of these Terms causes a third-party claim against us, you may be responsible for losses reasonably arising from that conduct to the extent permitted by law. This clause does not shift to you responsibility that the law places on us.

We will take reasonable steps to reduce the impact. This clause does not remove your right to an appropriate remedy if an order ultimately cannot be supplied or delivered.

We maintain a grievance mechanism for consumer complaints. Please provide your order number, contact details, and a clear description of the issue so that we can investigate. We aim to acknowledge consumer grievances within 48 hours and redress them within one month, in accordance with applicable e-commerce rules.

20. Governing Law and Disputes

These Terms are governed by the laws of India. We encourage customers to first contact us so that a complaint can be resolved promptly. Subject to any non-waivable right to approach a Consumer Commission, court, regulator, or other forum having jurisdiction under applicable law, disputes relating to these Terms or the Website will be subject to the competent courts at Ahmedabad, Gujarat.

21. Changes to These Terms

We may update these Terms to reflect changes in law, technology, business practices, products, or services. The current version and effective date will be posted on this page. Changes will apply prospectively unless applicable law requires otherwise. Material changes affecting existing orders will not be used to unfairly reduce rights already accrued for those orders.

22. Severability and No Waiver

If a provision of these Terms is held invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law. A delay or failure by either party to enforce a right does not permanently waive that right.
